General Terms & Conditions
The following terms govern the provision of Photography, Artistic Direction and Video services.
The session may take place in a studio, outdoors or at another location agreed between the parties.
Mara D’Eleán and/or her collaborating professionals will provide the services described in the quotation previously approved by the Client.
Mara D’Eleán retains technical and creative discretion regarding the choice of equipment, team and working methods.
The maximum duration of a session is eight hours, unless otherwise agreed. Any time exceeding this duration will be charged at the applicable additional hourly rate.
For artistic or conceptual sessions, the style and visual language will follow the Artist’s creative signature.
PAYMENT AND FINANCIAL TERMS
All prices and payment terms are specified in the quotation approved in writing by the Client.
Payment terms:
— Date reservation: a non-refundable booking retainer is required to confirm the booking and constitutes acceptance of these Terms and Conditions;
— Final balance: payable on the day of the session in cash, or by another payment method if agreed in advance;
— No material will be delivered until the full amount has been paid.
The prices stated in the quotation do not include VAT. An invoice containing the Client’s taxpayer identification number will be issued upon request. VAT will be added at the applicable statutory rate, currently 23%.
Mara D’Eleán reserves the right not to accept new commissions from a Client while any amounts relating to previous services remain outstanding.
CLIENT RESPONSIBILITIES FOR COMMERCIAL BRAND CAMPAIGNS
The Client agrees to:
— Provide clear and accurate information regarding the projects, garments, products, people or objects to be photographed, including their actual quantity and visual characteristics;
— Attend the commercial campaign session or appoint an authorised representative to be present;
— Ensure suitable working conditions for the entire team, including electricity, access and safety.
If neither the Client nor an appointed representative is present, the Artist shall not be held responsible for aesthetic or operational decisions made during the session, or for any damage to or omission of garments, products or other items.
The Client acknowledges that final responsibility for creative approval rests with the Client.
SUBCONTRACTING AND COLLABORATIONS
Mara D’Eleán may engage external professionals, including videographers, makeup artists and stylists.
Where such professionals are subcontracted by Mara D’Eleán, they will be managed exclusively by her.
Certain services may be contracted as independent services, each subject to its own prices and conditions.
BOOKING AND RESCHEDULING
A session is only confirmed after proof of payment of the booking retainer has been received.
Gift vouchers are valid for a maximum period of 12 months from the date of purchase.
A session may be rescheduled without additional charge by providing at least seven days’ notice.
If rescheduling is requested less than seven days before the session, a new booking retainer will be required, except in the following force majeure circumstances:
— Incapacitating illness affecting the Client;
— Death or serious illness of an immediate family member;
— Weather conditions unsuitable for an outdoor session.
Each booking may be rescheduled a maximum of two times. A third postponement will require payment of a new booking retainer.
The rescheduled session must take place within two months of the original date. Otherwise, the booking will expire.
CANCELLATION AND NON-ATTENDANCE
If the Client cancels without rescheduling, the booking retainer will not be refunded.
Failure to attend without providing at least 24 hours’ notice will be treated as a completed session, and the full amount will remain payable.
Mara D’Eleán may cancel the service without refunding the booking retainer if the Client fails to ensure the previously agreed conditions.
DELIVERY AND EDITING
If no specific delivery date is requested and agreed when the service is booked, the final images will be delivered through an online gallery within the standard period of 15 to 90 days following the session.
The applicable delivery period will depend on the type of session — commercial, personal branding, family, self-esteem, art therapy or event — and the Artist’s current workload.
Where the Client is required to select images, the delivery period will begin on the date the final selection is confirmed.
Following delivery, the Client assumes sole responsibility for storing and backing up the images.
Urgent editing requested without prior agreement is subject to an additional fee of €100.
Editing changes and additional photographs will be charged separately and may only be requested once, before final delivery.
No image substitutions or further editing will be carried out after final delivery.
Unedited photographs will not be delivered. Proof images may not be published or used for any other purpose.
The visual language of the final images — including tone, colour, luminosity and composition — will reflect the Artist’s signature style.
The Client may not apply filters or make alterations to the colour or composition of the final edited images without the Artist’s prior consent.
ADDITIONAL EXPENSES
The Client will be responsible for providing meals for the team where a session exceeds eight hours.
Travel outside Lisbon will be charged separately at a rate of €0.40 per kilometre.
COPYRIGHT AND IMAGE USE
Mara D’Eleán retains all copyright in the images.
The Client authorises the use of the images in the Artist’s portfolio, communications, social media and exhibitions.
Any withdrawal of this authorisation must be submitted in writing and will not affect material that has already been published or disclosed.
DATA PROTECTION
Personal data collected will be used solely for contractual and legal purposes.
It may be shared with essential service providers, including editing, printing and accounting professionals.
Files will be retained for six months unless an extended storage period is expressly requested and contracted.
FINAL PROVISIONS
Any matters not expressly covered by these Terms and Conditions will be resolved in accordance with the principles of good faith, ethics and proportionality.
Any dispute will be subject to the jurisdiction of the courts of Lisbon and governed by Portuguese law.
Payment of the booking retainer constitutes full acceptance of these Terms and Conditions.
